6th U.S. Circuit Court of Appeals says Tennessee has 1st Amendment right, too

The state would be within its rights to issue specialty license plates reading “Choose Life” while denying a plate encouraging abortion rights, a U.S. appeals court ruled yesterday.

Messages on Tennessee license plates are government speech, not a public forum as the American Civil Liberties Union argued, the majority decision of the 6th U.S. Circuit Court of Appeals said. While one-sidedness may be “ill-advised” on politically charged issues like abortion, the court ruled there’s nothing in the First Amendment that prohibits it.

What is happening to the judiciary in this country? Is it fear, as Sandra Day O’Connor suggests?

EDIT: I have become aware that my original intent was not made clear. Let me state it bluntly. Government has responsibilities. Government does not have civil rights. Civil rights are what we use to protect ourselves from the encroachment of government. That was the thought process behind my question above.

SD – Parental rights to rapists?

Here’s the text of the South Dakota abortion ban. And the chronology of it is here.

The text of the affected statutes:

3423A Performance of Abortions
22-17 Unauthorized Abortion.

And regardless of the mania sweeping the blogs right now, I see NO express granting of parental rights to rapists. Folks, we don’t serve our cause by looking like raving maniacs. This is, at best, nothing more than someone’s opinion on possible side affects of this new law. Perhaps this could happen, perhaps it won’t.

Another state tries to pass abortion ban

A Mississippi House committee approved a ban on abortions Tuesday, allowing an exception only in cases where the mother’s health is endangered.

The bill, which heads to the full House for a vote, makes Mississippi the second state in the nation to consider an abortion ban.

And so it begins.

S. Dakota legislature passes abortion ban, which would punish doctors who perform the operation with a five-year prison term and a $5,000 fine. It awaits the signature of Republican Gov. Michael Rounds and people on both sides of the issue say he is unlikely to veto it.

And yes, it’s clear, to me at least, this is intended to get to the Supreme Court to give that court the opportunity to overthrow Roe v. Wade.
